Saw it was running and jumped on it. Still don't see anything on it. More than likely with the sudden volume it will break out again.Daytraders are on it. I'm not buying anything to hold right now,as I am still P/O about IES.Looks like it's ready to break out again.

Tagatose Approved By European Union

BELTSVILLE, Md., Dec. 15 /PRNewswire-FirstCall/ -- Spherix Incorporated (Nasdaq: SPEX - News) today announced that tagatose has been formally approved as a "novel food ingredient" in the European Union (EU), permitting the use of the sweetener in a wide variety of products. The EU decision follows approvals of tagatose by regulatory agencies in the United States, South Korea, Australia, and New Zealand, and by JECFA, the Joint FAO/WHO Expert Committee on Food Additives.


Tagatose is Spherix's patented, low-calorie, natural sweetener that tastes and acts like table sugar. It is being used in a number of products sold on store shelves around the world. Tagatose can not only be used as a sugar replacement, but it also can be used to improve the mouthfeel, sweetness, and flavor profile of products containing high-intensity sweeteners. Unlike table sugar and many other sweeteners, tagatose is low-calorie, prebiotic, low- glycemic, does not promote tooth decay, and is safe for diabetics, all of which enhances its potential for use in foods and beverages.

The EU approval of tagatose is without any restrictions on usage. However, since tagatose is considered to be a fiber and is absorbed slowly and incompletely, food products containing more than 15 grams of tagatose per serving and beverages with a tagatose content of more than 1% must display the same type of informative statement that polyol-containing products are required to carry. In the EU, the allocation of a specific caloric value that differs from that of traditional sugars (4 kcal/g) requires a separate regulatory action. This action will be initiated in the near future by Spherix's food and beverage licensee Arla Foods of Denmark.

Gaio tagatose is manufactured and marketed by Arla Foods, which began commercial production of tagatose in 2003 in a 50/50 joint venture, "SweetGredients," with the German sugar producer Nordzucker. The product is distributed for food and beverage use by Arla. Food-use approval is also underway in Canada, Japan, and Mexico.

Spherix Shares Soar As Much As 55 Percent Following EU Approval for Use of Its Sugar Substitute


BELTSVILLE, Md. (AP) -- Health care research and products firm Spherix Inc. saw its shares climb as much as 55 percent Thursday, following European approval for use of its sugar substitute in a variety of foods.
The European Union approved the tagatose sweetener as a "novel food ingredient." The company said it has also been approved in the United states, South Korea, Australia and New Zealand.

Last week, the Food and Drug Administration cleared the company to start a late-stage clinical trial of the product in diabetics. The product -- which Spherix calls Naturlose in the United States -- is a low-calorie, fiber-based sweetener, the company said.

Spherix shares were up $1.11, or 35 percent, at $4.31 in afternoon trading on the Nasdaq after earlier reaching as high as $4.85.

  Spherix Surges Anew on Europe OK

Shares of Spherix (SPEX:Nasdaq - commentary - research - Cramer's Take) surged anew Thursday after the European Union approved the company's low-calorie sweetener as a "novel food ingredient."

In early afternoon trading, shares of the Beltsville, Md., company were up $1, or 32%, to $4.23, on heavier-than-normal trading volume.


Spherix, in a press release, said the EU's approval of tagatose will now permit the "use of the sweetener in a wide array of products."

The EU formally gave its approval for tagatose, a milk byproduct, on Dec. 14. The approval came from the U.K. Food Standards Agency. The agency acted on an application by Arla Foods, a Danish company that has had an exclusive licensing deal with Spherix to develop and market tagatose as a sweetener since 1996.

In 2001, Spherix received approval from the Food and Drug Administration to market tagatose as food additive in the U.S. To date, Spherix has not generated any meaningful royalties from the sale of tagatose to food and beverage companies by Arla.

One of Spherix's U.S. patents for manufacturing tagatose as a low-calorie sweetener is set to expire on Aug. 29, 2006, according to a company filing. The two patents it has for producing tagatose from whey expire in 2009 and 2011.

In approving tagatose as food sweetener, the Food Standards Authority imposed a labeling restriction on its use. The regulators said any product using more than 15 grams of tagatose per serving must contain the warning that "excessive consumption may produce laxative effects." A similar warning must appear on the packaging for any beverage that contains greater than 1% tagatose.

Meanwhile, Spherix is in the process of trying to market tagatose as a non-food additive for use in toothpaste, mouthwash and over-the-counter drugs under the brand name Naturlose. To date, Spherix says it has "yet to secure any substantial revenue from Naturlose sales."

But Spherix is also trying to find potential medical uses for Naturlose, most notably as a treatment for people with type 2 diabetes. Last week, the stock soared from $1.27 to $5 on news that the FDA had "cleared the way" for the company to begin the final phase of clinical tests on Naturlose as a diabetes treatment.

The stock gave back about half of those gains, after the TheStreet.com published a story about Spherix's difficulties in finding a market for either tagatose or Naturlose.

Don't know what tomorrow will bring since it's the end of the week.
Even though the price drifted downward after a high above $4.50 it still managed to gain strength AH tonight.
