Icahn reveals stake in Lexar Media

WASHINGTON (Reuters) - Billionaire investor Carl Icahn on Monday revealed that one of his investment vehicles no longer holds a $39 million stake in software maker Siebel Systems Inc. (NasdaqNM:SEBL - News), but picked up 2.4 million shares, or about 2 percent, of memory card maker Lexar Media Inc. (NasdaqNM:LEXR - News)as of September 30, regulatory filings showed.

The disclosure, in Icahn Management's quarterly 13-F filing with the U.S. Securities and Exchange Commission, also showed that Icahn cut his $102 million stake in Morgan Stanley to $13 million.

The quarterly disclosures include long positions, or bets that securities will increase in value and omits short positions, or bets that securities will decrease in value.

Icahn Management reported a total of $1.19 billion on long positions as of September 30, including a new 216,000-share stake in Walter Industries Inc. (NYSE:WLT - News) worth about $10.6 million.

The filing also shows that the portfolio continues to hold its 4.9 million share stake in Kerr-McGee Corp. (NYSE:KMG - News), a wise choice as the shares have increased in value to nearly $474 million as of September 30. from $372 million as of June 30.

The rules guiding the disclosures also allow filers to petition the commission for confidentiality for certain transactions. As he has done in past filings, Icahn requested such confidentiality for unspecified holdings in his personal filings as of September 30.

Ascending Triangle (continuation) Pattern.

The ascending triangle is a bullish formation that usually forms during an uptrend as a continuation pattern. There are instances when ascending triangles form as reversal patterns at the end of a downtrend, but they are typically continuation patterns. Regardless of where they form, ascending triangles are bullish patterns that indicate accumulation

Because of its shape, the pattern can also be referred to as a right-angle triangle. Two or more equal highs form a horizontal line at the top. Two or more rising troughs form an ascending trend line that converges on the horizontal line as it rises. If both lines were extended right, the ascending trend line could act as the hypotenuse of a right triangle. If a perpendicular line were drawn extending down from the left end of the horizontal line, a right triangle would form.

In contrast to the symmetrical triangle, an ascending triangle has a definitive bullish bias before the actual breakout. If you will recall, the symmetrical triangle is a neutral formation that relies on the impending breakout to dictate the direction of the next move. On the ascending triangle, the horizontal line represents overhead supply that prevents the security from moving past a certain level. It is as if a large sell order has been placed at this level and it is taking a number of weeks or months to execute, thus preventing the price from rising further. Even though the price cannot rise past this level, the reaction lows continue to rise. It is these higher lows that indicate increased buying pressure and give the ascending triangle its bullish bias.

You know what i love? what i love is LEXR, this gonna stay in my portfolio in the long, long-term.. why? .... Memory Cards manufacturers is increasing the capacity of the cards at least every 2 years... I think in the near future, instead of hard-drives you gonna start seeing Memory cards @ super high-capacity, or NAND-Flash memory in all the very famous MP3 Player "Apple IPOD's"...........We are in the battle of storage media... Hard-drive Perpendicular (New Technology) VS. Super High-Capacity Memory Cards (No moving object) what would you pick??? ;)

Toshiba Appeals to Higher U.S. Court in Flash Memory Dispute


TOKYO (AP) -- Toshiba has filed an appeal to a higher court after it was granted a new trial in California in an ongoing legal dispute with Lexar Media Inc. over trade secrets for flash memory chips, the Japanese electronics maker said Tuesday.


The Santa Clara County Superior Court last Friday ordered a new trial after Toshiba Corp. filed a motion to reconsider the court's Oct. 14 ruling that had ordered Toshiba and its U.S. subsidiary to pay Lexar $465.4 million.

In that ruling, the court upheld a March jury verdict that said Toshiba stole Fremont, Calif.-based Lexar's trade secrets on flash-memory chips, which are used in portable music players, cell phones and other electronics products. Flash memory is a strategic technology for Toshiba.

Toshiba has denied wrongdoing.

In the latest move, Toshiba filed an appeal Monday in the California appeals court on parts of the lawsuit affected by the decision for a new trial, the Japanese firm said in a statement.

The court had said there was insufficient evidence to support the ordered damage payment, although the court did not overturn the jury's verdict.

"Toshiba is very pleased with the court's ruling last Friday, vacating what we consider to be an erroneous verdict on damages," the Tokyo-based company said in a statement. "We have strongly contested the allegations and denied wrongdoing throughout the proceedings and will continue to pursue all legal avenues."

In the lawsuit filed in 2002, Lexar said its secrets were misappropriated when then-partner Toshiba entered into a deal with SanDisk Corp., another memory chip maker and Lexar's biggest competitor.

After the jury verdict earlier this year, Lexar unsuccessfully sought an injunction to bar sales of Toshiba products using Lexar's technology in the United States.

Lexar also has a patent infringement case against Toshiba pending in federal court.
