Big move for INSM today, 1.70 falling wedge target MADE.

Scotsman, Id Fix and soxguy,

It sure did!

I figured that it would finally quit morphing, once I sold it.   Curses!  >:D  :D

Nice job, guys.  Glad to see it rallied for you.  Applauds.

ScottishTrader

Hey Id,

I would really prefer it if you didn't keep posting links to our 3sof analysis on the Yahoo MBs.  While I know that that is how I first found 3sof, I would rather keep our analysis and our ideas within our community.  I really don't want all the pumping idiots heading over here, especially from the INSM board (which while it does have a lot of good info, also has some real idiots).

Thanks,

ST

Sorry...
wanted to educate them . :-[

don't bother, it really isn't worth it...

by the way, sold 1/3 of my position this morning to protect some profits.  Still think it will go higher by next week.  Good luck to us ;)

Another monster day for INSM with ridiculous monster voulme - I'm really liking this buy the way (despite selling some).  Just thought I would put a heads up here for that slightly nasty looking 1.83 gap to crap resistance that we just kicked our heads against today from the June fakeout rally.  It could cause some problems, but if the trial is dismissed and things get crazy, it shouldn't be a problem.  We are also heading into "sell the news" territory, so we may see a sell-off when the trial PR comes out regardless of the outcome.  I'm working on being prepared for any eventuality and am raising my stop to 1.59.  Above 1.83, I think we may see resistance at 2.00 (well, duh) and 2.10 above that, but if we got to $2 I would be veeery happy (though really I wanna see 3, but lets not get ahead of ourselves here...)  Anyway, here's the chart update:

Those who are interested by the Jury's trial which opposes INSM to TRCA/DNA....

(The verdict will be known next week)

Insmed was accused to infrige 3 patents...n°151, 287 and 414

INSM doesn't infrige the 151 and 414 patent  :P

INSM doesn't infrige the 287 patent also :P

Case No. C-04-5429 (EMC)

HOWREY

I. INTRODUCTION
Defendants INSMED INCORPORATED, CELTRIX PHARMACEUTICALS, INC., and
INSMED THERAPEUTIC PROTEINS, INC. ("Defendants" or "Insmed") respectfully submit this
Motion for Judgment as a Matter of Law Re: Failure to Establish Infringement of the '287 Patent
pursuant to Federal Rule of Civil Procedure 50(a). GENENTECH, INC. and TERCICA, INC.
("Plaintiffs" or "Genentech) have been fully heard on their claim that Insmed has infringed the asserted
claims of U.S. Patent No. 5,258,287 ("the '287 patent") and they have failed to meet their burden of
proving infringement of the '287 patent. The Court is respectfully requested to grant judgment as a
matter of law in favor of Defendants on the grounds that, based upon the evidence presented, no
reasonable jury could find that Defendants infringe the '287 patent. Plaintiffs claim of infringement of
the '287 patent should thus be dismissed.

So... it seems that the case is O.V.E.R ...

-->Inequitable conduct hearing next Wednesday

Waiting for the Court's decision..last step !...
The stock will  move up seriously ...if it's ok 4 us

short term,it all depends on this trial. obviously good news is anticipated. i'm trying to look down the road. they have other drugs in the pipeline i believe. anyway, the recent increase in the pps has justified my reasons for staying long at all. a side note..when i read micheal's call on aspv, in minutes i sold my sai and bought aspv at 17.73. of course it went down the next day. but i'm optimistic. also in rnvs too. that's long term. we shall see. i get into something like that because of plays like pozn which i focused on when it declined ,then i lost track of. since it's thanksgiving here in the states, you may not have what you want, but be thankful for what you have.   soxguy

Further continuation on Friday of this move on very strong volume: over 14M shares traded this week and up over 30%, now that is a stock on FIRE!!! Obviously it all comes down to the trial this week, but as I said elsewhere, just look at TRCA  in comparison:  less than 500k traded and it is down 1% for the week.  I think we know where the smart money is hedging their bets on this one.  I doubled my position in INSM on Friday as it broke through key 1.83 resistance, and regardless of what happens with the case I will sell half my position when the trial results come out.  I wouldn't be surprised to see a big gap up and "sell the news" if it comes out favourably - a lot of people have held losing positions in INSM for a long time.  But longer term, with the trial out of the way, things should start looking better for INSM.  All aboard!! Choo choo!!  :D :D

That legal action from Genentech and Tercica was always a cloud on INSM. If that issue gets out of the way, hopefully to the better for Insmed, it is a positive development.

The 66% rally in November was discounting that possibility, not yet confirmed (hence the recent decline).

If we get good news, probably the stock will trade around $2 again. If the news is negative it will tank hard, probably 15 or 20% in one day.

It is essential that the court ruling turns out positive for INSM, but it doesn't solve other problems, like the $158 M market cap without relevant revenues and the constant need to make private placements (well, not soon, as their balance sheet is strong now).

My biggest concern is the market size of iPlex. When I first bought the stock I thought it was much larger. I thought the drug was to make small children grow more, so nobody would be less than 150 cm tall when an adult (I know you don't use the metric system, but I don't know your system). Anyway, on my limited information I expected iPlex to help short children grow more, but no, after all it is just for a small number of children that suffer of Severe Primary IGFD. I remember there were just 20 or 30 thousand children with the disease in the US.

With the current information I don't see a big potential on the stock, but good luck for everybody holding :)

Verdict is out:

Insmed Infringed Genentech Hormone Patents, Jury Says (Update1)

By Joel Rosenblatt

Dec. 6 (Bloomberg) -- Insmed Inc., a maker of drugs for endocrine disorders, infringed three patents covering a treatment for abnormally short children, a jury said today in a lawsuit brought by Genentech Inc. and Tercica Inc.

The jury in Oakland, California, federal court awarded Genentech and Tercica $7.5 million in damages and a percentage of future sales of the treatment. Insmed shares fell 11 percent, or 17 cents, to $1.42 at 3:25 p.m. in Nasdaq composite trading.

Insmed's Iplex and Tercica's product, called Increlex, are growth drugs used to treat about 6,000 short children who don't respond to normal human growth hormones. The drugs also have off- label uses, such as increasing body mass. Tercica paid a licensing fee to Genentech, the world's second-biggest biotechnology company, to manufacture Increlex.

The jury verdict was ``disappointing but not surprising,'' said Henry Bunsow, a lawyer for Insmed. He said he would appeal. Lawyers for Genentech and Tercica asked the court today for an injunction barring future sales of Insmed's treatment.

Genentech and Tercica sought damages of $10 million, receiving $7.5 million as part of today's verdict. The jury also awarded the plaintiffs a 15 percent royalty, or as much as $15 million, on the first $100 million of Iplex sales. Genentech and Tercica also received a 20 percent royalty, or as much as $20 million, on the second $100 million of Iplex sales.

$1 Million

Genentech shares fell 47 cents to $83.05 at 3:25 p.m. in New York Stock Exchange composite trading. Tercica shares rose 17 percent, or 89 cents, to $5.99 in Nasdaq composite trading. Insmed has had $1 million in sales of the drug since its introduction, said Terry McMahon, a lawyer for South San Francisco, California-based Genentech and Brisbane, California- based Tercica, during closing arguments.

Richmond, Virginia-based Insmed argued Iplex was researched for more than 20 years and that it was made and approved by regulators with respect for existing patents.

In June, U.S. District Judge Claudia Wilken ruled Insmed infringed one of the three disputed patents, leaving the remaining claims for the jury to decide.

The case is Genentech Inc. v. Insmed Inc., 04-cv-5429, U.S. District Court, Northern District of California (Oakland).

Insmed "buy"

Monday, February 19, 2007 4:07:30 AM ET
Lazard Capital Markets

NEW YORK, February 19 (newratings.com) - Analysts at Lazard Capital maintain their "buy" rating on Insmed Inc (ticker: INSM). The target price is set to $3.

In a research note published on February 16, the analysts mention that as a result of stipulation submitted to the court by Insmed and Tercica, the preliminary injunction hearing has been delayed. The reasons for the delay in the hearing and when it would be scheduled appear uncertain, the analysts say.
