What do you all think of EMKR?  The semiconductor sector seems to be performing well, and this stock has been hitting new highs lately.  I might buy a little bit of it on Monday.

Emcore Shareholders File Suit

2 Emcore Shareholders File Derivative Lawsuits Against Board Members, Former Executives


NEW YORK (AP) -- Emcore Corp. said Friday that two of its shareholders have each filed a derivative lawsuit against certain members of the company's board and certain current and former executives.
The company, which makes fiber optic components used in satellite, solar and broadband applications, has been named as a nominal defendant in each of the actions, Emcore said in a filing with the Securities and Exchange Commission.


The complaints, which were served on Monday, accuse improprieties and violations of law in connection with Emcore's historical issuances of stock options.

Both lawsuits seek damages, equitable relief, corporate governance reforms, restitution and costs and disbursements related the lawsuit, the company said.

Emcore said its board plans to review the allegations and respond appropriately.

The suits were filed in the Superior Court of New Jersey, according to the filing.

Emcore also said in Friday's SEC filing that Nasdaq Stock Market has stayed its decision to delist the company's shares pending further action by its listing council, which will not occur before Aug. 10, the company said.

Emcore shares rose 2 cents to $4.92 in aftermarket trading, after rising 10 cents, or 2.1 percent, to $4.90 in the regular session.

Emcore Gets Nasdaq Warning

Emcore Warned of Possible Nasdaq Delisting Because of Delayed Quarterly Report


ALBUQUERQUE, N.M. (AP) -- Emcore Corp., a maker of fiber optic components used in satellite, solar and broadband applications, said Wednesday it received a notice from Nasdaq Stock Market that it could face delisting due to the delayed filing of its results for the quarter ended March 31.
The company's quarterly report had a filing deadline of May 10. Emcore said it expected the Nasdaq warning.

To maintain listing on the stock exchange, Emcore must file its outstanding results for the fiscal year ended Sept. 30, 2006, and for the quarter ended Dec. 31, 2006, by June 18. Emcore said that it will request an extension from a Nasdaq listing panel if it cannot meet that deadline.

The company is one of at least 211 companies that have launched internal probes or are under federal scrutiny for possible backdating of stock option grants.

EMCORE may be delisted

Emcore Corp. has announced it is under threat of delisting by the NASDAQ stock market.
The Albuquerque-based fiberoptics and solar cell manufacturer (NASDAQ:EMKR - News) said Wednesday it received a letter Monday from NASDAQ saying its failure to file a required report had made it subject to delisting. EMCORE said it had been expecting the letter because its ongoing review of prior stock option grants have so far prevented it from filing Form 10-Q.


Based on the ongoing review, EMCORE said in November 2006 it was likely that measurement dates for certain stock option grants differed from the recorded grant dates for those awards. The company announced that, as a result, financial statements included in its annual and interim reports for the periods beginning with fiscal year 2000 could no longer be relied upon.

The company has been granted continued listing subject to certain conditions, including that it file this and other forms no later than June 18, a deadline the company does not promise it will meet, though it will make "every effort" to do so.

The company says it will ask for an extension if it cannot meet the deadline.

EMCORE will supply and install turnkey solar power systems in the Sault Ste Marie area utilizing EMCORE's concentrating photovoltaic (CPV) systems developed at its Albuquerque, NM facility. EMCORE also has the right to substitute other solar technologies in portions of the projects. The project developer, Pod Generating Group (PGG), has secured the licenses and permits for the project through the Ontario Power Authority Standard Offer Program and system deployment is expected to begin in mid-2008. The news was applauded by investors who were waiting on some large contract announcements.
Shares gained some 19% on 3.2 million shares traded. CIBC analyst called the deal a potential
catalyst for the stock as the agreement could bring some $200 million to $250 million in revenue to the Company over the next three years
. The firm also called the company a cheap way to play solar, since its shares are only $11 where most other solar names have seen their shares soar into the $30's, $40's, and S50's with FSLR's shares touching $250.
The gallium arsenide used in the solar panel construction is noted as being more efficient than
silicon based cells.
The higher efficiency makes them more suitable for use in satellite applications. But the higher efficiency most likely comes with a higher price tag. Silicon is also highly abundant in the Earth's crust and cheap to process. The economies of scale have made gallium arsenide adoption reduced when compared to silicon.
But as many are aware, silicon is becoming in short supply because of the solar and semiconductor demand. Gallium arsenide can also be used in semiconductor use but have much higher power consumption which have made them unable to compete with silicon.
Even so, with silicon coming under short supply internationally with the ramp up in production of solar cells and semiconductors, the name is certainly one to follow with their substitute gallium arsenide solar cells which are more efficient. Investors would be wise to watch.

Nice, some solar charts are starting to look good again.

I'm surprised the street liked ESLR's #s, I thought they were terrible!  20 mil in revenues and over $1 bil market cap.  I just don't understand how it adds up...some technology they have that will dramatically increase their earnings potential in the future maybe...? I dont know.
