TOA looks like a good short entry. It has had a big rebound from the low in the 6s about 3 months ago. TOA seems to have hit a wall with heavy resistance above in the 10.50-11 range. The profits are declining for TOA and there is also several class action lawsuits against this homebuilder.

Becareful going long this stock is plagued with lawsuits and has a high risk of going bankrupt. Though I definately wouldnt be going short here so it could make a good rebound for a few days on the long side.

Wall Homes to Double Size with Acquisition of Dallas/Fort Worth Division of Newmark Homes

ARLINGTON, Texas, May 10 /PRNewswire/ -- Steve Wall, founder and CEO of Wall Homes, a homebuilding company based in Arlington, Texas, and Newmark Homes, a subsidiary of TOUSA (NYSE: TOA - News) have announced that Wall Homes has entered into an agreement to acquire a substantial amount of the assets of the Dallas/Fort Worth division of Newmark Homes, including raw land, site developments, finished lots, and construction in process.

With the acquisition, Wall Homes will increase its active neighborhoods in Texas to nearly 50 from 28.

"This is an amazing opportunity for Wall Homes," said Steve Wall. "Newmark parallels Wall's market focus and dedication to customer service and satisfaction. With the acquisition, we begin our third year in business at twice the size we were at the end of our second year. It's a great fit."

Newmark has built and sold homes throughout Texas and Tennessee for more than 20 years. In the DFW area, Newmark's 20+ active communities, with prices ranging from $126,000's-$400,000's, will become Wall Homes neighborhoods effective early June.

The sale does not affect other Newmark divisions.

Until closing, which is anticipated for May 31, 2007, Wall Homes will conduct employee evaluations and consideration of reassignments within the expanded Wall organization.

UPDATE 1-TOUSA gets loan commitments from Citigroup Global

May 17 (Reuters) - Homebuilder Technical Olympic USA Inc. (TOA.N: Quote, Profile, Research said Citigroup Global Markets Inc. has agreed to provide the company two new $250 million loan facilities.

Shares of the company were up more than 6 percent at $4.16 in morning trade on the New York Stock Exchange.

TOUSA expects to use the proceeds to fund any settlement related to its Transeastern joint venture.

As a condition to the new facility, the company's commitment under its $800 million revolving loan facility will be reduced by $100 million, TOUSA said in a statement.

TOUSA said it does not expect to execute the commitment letter unless it has entered into settlements with the creditors to the venture.

It has until May 28 to execute the commitment letter, Hollywood, Florida-based TOUSA said in a statement.

TOUSA has been in trouble with lenders for Transeastern amid a slump in the housing market in the United States.

Early this year, TOUSA started settlement discussions with the lenders and offered to buy some or all of the venture's assets. (Reporting by Ankur Relia in Bangalore)

TOUSA gets extension on loan from Citigroup Global
May 29 (Reuters) - Homebuilder TOUSA Inc. (TOA.N: Quote, Profile, Research said it received an extension of the written commitment from Citigroup Global Markets Inc. for two $250 million loan facilities.

The company had until May 28 to execute the commitment letter for the loan, proceeds of which would be used to fund any settlement related to its Transeastern joint venture.
