UPDATE 2-China says boy tests positive for bird flu-reports

BEIJING, Nov 16 (Reuters) - A senior Chinese official says H5N1 antibodies have been detected in a nine-year-old boy in Hunan province, the first admission of a human bird flu infection in China, the South China Morning Post reported on Wednesday.

China's Health Ministry could not immediately confirm the report.

The semi-official China News Service, quoting Qi Xiaoqiu, director of the Ministry of Health's department of disease control, said the government was waiting for the results of a joint investigation with the World Health Organisation before confirming whether the boy was the first human case of avian influenza in the country.

But the China News Service did not say which strain of bird flu the boy had tested positive for.

"During the early stage, antibodies were found, but now the boy is positive to antibody tests," the news service quoted Qi as saying. The comments also were reported by Hong Kong's South China Morning Post newspaper.

"We are waiting for the advice of the WHO. The WHO has a set of procedures to confirm a case and it usually takes two laboratories to confirm."

He Junyao and his 12-year-old sister fell ill last month and were treated for pneumonia symptoms. The boy was discharged from hospital last weekend but his sister died.

Chinese officials said initial tests showed she had tested negative for bird flu.

The WHO is sending a team this week to the southern province of Hunan to investigate the cases, which China later said could not be ruled out as bird flu. The children lived close to the site of a poultry outbreak.

The H5N1 virus has killed more than 60 people elsewhere in Asia since 2003 and is endemic is poultry flocks in many parts of the region. Almost all of those who died had been in close contact with infected birds.

Health experts fear millions could be killed around the world if the virus mutates to the point where it could spread easily from person to person.

Battling to control several outbreaks of the H5N1 virus, China vowed on Tuesday to vaccinate its entire stock of 14 billion poultry, with the government footing the bill, as it scrambles to prevent more outbreaks.

It gave no timetable for the inoculation campaign.

China is also probing a possible human infection in a northeastern province, the World Health Organisation said on Monday.

Roche settles dispute with Gilead
Wednesday November 16, 6:24 am ET
By Tom Armitage

ZURICH (Reuters) - The main producer of Tamiflu, the drug thought to be the best defense against a possible flu pandemic caused by bird flu, has settled a dispute with the drug's inventor over production and royalties, the companies said on Wednesday.

Governments have been seeking to stockpile the drug as a precaution against the possible outbreak of a human variant of avian flu but drug maker Roche Holding AG (ROG.VX) has come under pressure over concerns production could fall short.

Under Wednesday's deal the drug's inventor Gilead Sciences Inc (NasdaqNM:GILD - News) will get a greater say in plans to increase production of the drug by farming out parts of the process to third-party producers such as generic drug makers.

Gilead's share of the royalties from Tamiflu sales, which are expected to reach over $1 billion due to government orders, will remain unchanged, although it will no longer have to shoulder the burden of certain manufacturing costs.

"The money is not a great deal," said Claude Zehnder, market analyst at Swiss bank ZKB said. "But it is certainly a good thing that they have agreed this amicably."

The settlement also involves Roche paying the U.S. firm around $62.5 million in reimbursements for so-called cost of goods adjustments backdated to the start of 2004.

Investors in the Swiss drugmaker had feared that the dispute, which broke out in June, could weigh on the firm's shares or scupper Tamiflu sales.

Roche's participation certificates were 0.4 percent higher at 194.40 Swiss francs by 0806 GMT, in a flat Swiss market.

Gilead threatened in June to end a deal signed in 1996 under which Roche got an exclusive license to manufacture and sell the antiviral drug worldwide.

The U.S. firm claimed Roche had failed to market the drug properly, particularly in the United States, and had not launched the drug as a treatment for seasonal flu in other countries.

If Gilead had won, all rights to the drug would have reverted back to the U.S. firm.

Roche has come under pressure from governments around the world to increase its production capacity for the treatment and said last month that it would consider allowing other parties, such as generic drugmakers, to produce the remedy.

Gilead will also have a greater say in selling Tamiflu as a seasonal flu treatment and will have the option to co-promote the drug in specialized areas in the United States. However, it will not co-promote the drug in 2006, it said.

Roche said that Gilead's royalties would remain unchanged, with the U.S. firm receiving a cut of between 14 and 22 percent based on Roche's annual net sales of the drug.

This would work out at 18 to 19 percent for 2005, the firms said. Roche has already sold 859 million Swiss francs worth of Tamiflu in the first nine months of 2005.

Roche will pay Gilead the $62.5 million in royalty reimbursements and has said that the U.S. firm could keep $18.2 million which Roche had paid in protest over a dispute on royalty calculations for sales in 2001 to 2003.

Holly Springs tops Roche's list
Giant drug firm wants to build $750M plant to fulfill flu vaccine demand
Amanda Jones
HOLLY SPRINGS - Swiss drug giant Roche has identified the Triangle as the top location in North Carolina for the construction of a $750 million plant to produce Tamiflu, an anti-viral treatment for the flu.

Roche has hired a site consultant to aid in its search, which has included locales across North Carolina. Sources say the company has identified an industrial park in Holly Springs as its favorite.

No decision has been made, though, and a Roche spokesman did not respond to requests for information, including whether the company is looking in other states.

The Roche search is being sped up by national and international concern over the possibility of a bird flu pandemic. The company is not alone in planning a new production facility, but no others are known to be looking in North Carolina.

Roche already has U.S. Food & Drug Administration approval to build a Tamiflu production facility in the United States. The company announced Nov. 7 that it would increase production of Tamiflu to make 300 million doses of the drug annually by 2007, a tenfold increase in production since 2004.

Even so, Roche's stockpiles will not be able to fulfill all orders if a flu pandemic should occur. To help fill the supply gap, the company is negotiating with Mylan Laboratories and other generic drug makers to bump up production of Tamiflu in 2006.

Mylan has a history in the Triangle. It moved the headquarters of its Mylan Bertek Pharmaceuticals subsidiary to Durham in 2001 and shut down the Durham operations in June. Mylan has about three years remaining on its lease at Keystone corporate park for laboratory and office space where it had employed 100 people.

Roche has the exclusive manufacturing patent for Tamiflu through 2016. A course of the oral drug costs about $60 to $80 and has a shelf life of five years. The company expects sales of Tamiflu to triple in 2005 to as much as $925 million.

Other companies are working to get new production facilities up and running.

Novartis, which recently acquired the remaining shares of flu vaccine maker Chiron, is considering building a plant in the United States, where it has a $62.5 million government contract to supply pre-pandemic H5N1 influenza vaccine.

Repost from Yahoo MB today:

ketchdawind,

I am a swing trader who is more concerned about day to day stock trend than long term performance of a stock.

However, Novavax has been doing some "nice" work to improve their balance sheet and to make the company very "attractive" for corporate partnership/merger - and the CEO has been actively seeking such business venture.

At the present, things have improved for Novavax and I don't see any "blemish" that can hold Novavax back. The worrisome debt problem is gone. New management team is transitioning well. They have cash on hand and cash flow is improving. They are working on ongoing licensing of their products to other national pharmaceutical companies to market their products, instead of selling "direct retail"

With recent price correction and "rebound" of NVAX stock, technicals are improving and I am very bullish on NVAX.

I don't use any "special" software. I use Yahoo Technical Analysis, stockta.com, StockChart Sharp Chart, Lycos I-watch, and MSN volume intraday/week/month gainer and BarChart TA composite indicator to form my opinion and use "basic, not elite" Scottrade account ($7/trade!).

Yes, I am a "full on" swing trader, so I will take profit whenever an opportunity is presented, only to buy back more shares on dip.

Good trading!
