Indiana Governor Mitch Daniels and Dept of Natural Resources Director Kyle Hupfer announced the new contract late last week. Co says it had successfully completed its first 4-year contract and won the competitive re-bid.

Spherix Agrees to $6 Million Settlement to Drop Protest Over Award of National Park Service Contract

Spherix Incorporated (Nasdaq: SPEX) has agreed to a $6 million settlement to end its longstanding legal dispute with the U.S. Department of Agriculture over the government's award of the National Recreation Reservation Service contract to ReserveAmerica, a Ticketmaster subsidiary.

Spherix officials are pleased with the settlement, which will provide additional finances to allow the Firm to move forward with important projects while eliminating the legal fees, effort, and uncertainty that would persist were the four-year dispute to continue.

"This is good and very welcome news," said Spherix President and CEO Richard Levin. "Financially, the settlement readily achieves fair compensation for the Company and its shareholders, and will permit us to focus on the future. It will allow us to invest more time, resources, and money in developing new products we've had planned for our reservations business, which will allow us to be even more competitive in the state and local markets where the potential for steady growth is much greater. We're happy to be able to move positively and confidently into the future."

InfoSpherix, the Company's wholly-owned subsidiary that operates its ReserveWorld business line, won two more state parks reservation contracts in the past month, and is a subcontractor on a third, smaller winning state park proposal. The settlement is expected to strengthen and expand InfoSpherix's offerings in the state and county markets, and potentially in the commercial recreation market, with advanced tools for camping and boating reservations, point-of-sale transactions, online ticketing, property management, facility rentals, and other park support functions.

Background:

In the past three years, the USDA Forest Service has twice awarded the contract for the National Recreation Reservation Service to ReserveAmerica. Both times, Spherix lodged and won protests of the award, with the Government Accountability Office finding flaws in the procurement that unfairly disadvantaged Spherix in the competitive evaluation of proposals.

Spherix and ReserveAmerica have held separate contracts to operate reservation services for the National Park Service and the Forest Service, respectively, since 1997. In 2002, the U.S. Office of Management and Budget required that the two contracts be bundled into one, under the auspices of the Forest Service. The two companies have continued to operate their respective contracts throughout the succeeding procurements, protests, and legal challenges. With the settlement in place, Spherix is expected to continue operating the National Park Reservation Service until Ticketmaster/ReserveAmerica is able to deploy its reservations system over the combined inventory of national parks, recreation areas, historical sites, and other reservable federal lands.

Spherix to Begin Recruiting Participants for Phase 3 Diabetes Trial

BELTSVILLE, Md., Oct. 26 /PRNewswire-FirstCall/ -- Spherix Incorporated (Nasdaq: SPEX - News) has successfully completed its dose range-finding study, allowing it to continue with its Phase 3 clinical trial of Naturlose as a treatment for type 2 diabetes (see Spherix news releases dated May 23, 2006, and August 10, 2006). The tests were done on human subjects to establish the appropriate dosage and timing to be used in the upcoming trial. The Company will now recruit patients for the trial, which will take place in Australia and the United States. Company officials expect that the first participants will begin the Phase 3 clinical trial by April 2007.

"Not only did they determine the dose and timing for the trial, but the results corroborate what we have seen in smaller, previous tests -- that Naturlose has a beneficial effect on modulating postprandial blood glucose, an important factor in the treatment of Type 2 diabetes. We are moving forward with confidence that we have a scientifically sound foundation on which to complete the Phase 3 trial, and to anticipate a favorable outcome."

Levin said that the Company's recently announced settlement of a contract dispute (see Spherix's PR released earlier today) in its reservations business will bolster its financial ability to support Naturlose. In that settlement, Spherix agreed to accept $6 million to end the longstanding legal dispute over the award of the National Recreation Reservation Service contract. Spherix intends to use a portion of that payment to support its efforts to develop Naturlose as a marketable product. Spherix believes these funds, along with existing cash, will ensure its ability to complete the Phase 3 clinical trial.

If the Phase 3 trial establishes that Naturlose is an effective treatment for diabetes, Spherix will prepare a New Drug Application (NDA) for presentation to the Food and Drug Administration (FDA). FDA approval would give Spherix the right to market Naturlose as a diabetes drug. Naturlose has already been shown to be safe.

SPEX is stepping......Impressive ! ;D
In the short term, this one could easily test its old resistance @ $3.50, and I wouldn't rule out a surge back to $4.00 in the next week or two.
SPEX has an "all natural" sugar substitute called "Tagalose" that apparently is gaining some interest, particularly on the west coast of the US.

Excellent TA.

The fundamentals definetly check out on SPEX.  The market cap is a tiny $33MM with a $24MM EV, with cash in the bank and little debt.  They are basically running breakeven.

Latest filing summarizes it's bright spots:

BELTSVILLE, MD, Spherix Incorporated (NASDAQ/SPEX) reported revenue of $7.3 million and $20.8 million for the three-months and nine-months ended September 30, 2006, up 8% over the same periods in 2005. The increase between years is the result of a new government reservation contract, which the Company began performing early in 2006. During the three- and nine-month periods, the Company's R&D costs were $441,000 and $723,000, respectively; an increase of $400,000 and $511,000, respectively, over the same periods of the prior year. The increased expenditures resulted from the escalation of activity relating to the Phase 3 clinical trial of Naturlose as a treatment for type 2 diabetes. A range-finding study was successfully completed, and provided encouraging early signs (see Spherix news release dated October 26, 2006). NATURLOSE AS AN AGENT TO IMPROVE BLOOD TRANSFUSIONS:

On November 3, 2005 SPEX announced that it has signed a Naturlose License Agreement with the Albert Einstein College of Medicine to seek products to enhance blood transfusion technology

Under its license, the BioSpherix Division of SPEX gains the rights to Naturlose-containing products and processes under development at Einstein that enhance storage lifetimes of medicinal proteins, including blood components; Spherix will pay royalties to Einstein on sales of any forthcoming patented products or processes.

In its first annual report on the research effort, Einstein said that Naturlose " ... is an especially promising stability-enhancing additive to a wide range of dry protein formulations (which includes the essential blood component, hemoglobin)."
